TERMS & CANCELLATION POLICY

1. Cancellation and Refund Schedule

The following fees apply based on the notice period provided by the guest prior to the scheduled check-in date:
•    14 Days or More: Cancellations made 14 days or more before check-in are eligible for a 100% refund of the advance deposit.
•    7 to 13 Days: Cancellations made between 7 and 13 days before check-in will incur a charge of 50% of the advance deposit.
•    Less than 7 Days: Cancellations made less than 7 days before check-in are non-refundable.
•    96 Hours (4 Days) or Less: Any cancellation made within 96 hours of the check-in date results in the total forfeiture of the advance deposit. The guest explicitly waives all rights to a refund, as this amount is retained as earnest money for the breach of the booking contract.

 

2. Rescheduling & Modification Terms

Management Discretion: All requests to change or extend check-in dates are subject to the sole approval of Willowdale Management. Management reserves the right to deny any rescheduling request.
•    Date Allocation: If a rescheduling request is granted, the new check-in date will be provided according to Willowdale Management’s availability, not the guest's preferred dates.
•    Price Adjustments: If the rates for the new dates are higher (due to seasonality, weekends, or tariff hikes), the price difference must be borne entirely by the guest.

 

3. Force Majeure (Natural Events & Roadblocks)

Willowdale Management shall not be held liable for failure to perform its obligations if such failure is the result of Acts of God or Force Majeure.
•    Defined Events: This includes natural disasters (landslides, flash floods, cloudbursts, earthquakes), official government-mandated lockdowns, or civil unrest.
•    Road Closures: In the event of documented roadblocks or highway closures confirmed by the Uttarakhand Police or USDMA, management may, at its sole discretion, offer a credit for future dates. Standard cancellation fees apply if the property remains accessible via alternate routes.

 

4. No-Show Policy

If a guest fails to arrive by 11:59 PM on the scheduled check-in date without prior written notice, the booking will be treated as a No-Show. The entire advance is forfeited, and the room may be released for other bookings.

 

5. Governing Law and Jurisdiction

This policy is governed by the laws of India. Any disputes or legal claims arising out of this booking shall be subject to the exclusive jurisdiction of the courts in Nainital, Uttarakhand.
